TERMS & CONDITIONS

These Terms & Conditions (“Terms”) govern your use of this website and purchases made through Thermal Motion Group. Thermal Motion Group is a brand used by CJP Metal Fabrication, LLC, an Ohio limited liability company (“Company,” “Seller,” “we,” “our,” or “us”).
By accessing this website, requesting a quote, submitting information, or placing an order, you agree to these Terms.
1. Customer Types
This website serves both:
(a) Individual consumers purchasing for personal use (“Consumers”), and
(b) Businesses purchasing for commercial, industrial, governmental, resale, fleet, OEM,
installation, or professional purposes (“Commercial Buyers”).
Certain provisions apply differently depending on customer type.
2. Commercial Terms Override
If you are a Commercial Buyer, any commercial sale, repeat business transaction, wholesale
purchase, dealer purchase, or business-use purchase shall additionally be governed by our
Commercial Terms & Conditions of Sale, and commercial provisions shall control to the
maximum extent permitted by law.
3. Orders and Acceptance
All orders are subject to review and acceptance.
We may reject, limit, hold, or cancel orders for pricing errors, inventory shortages, suspected
fraud, sanctions/export concerns, identity verification issues, or other commercially reasonable
causes.
Automated order confirmation does not constitute final acceptance.
4. Pricing
Prices are shown in U.S. Dollars unless otherwise stated.
Prices may change without notice.
We reserve the right to correct typographical, pricing, freight, tax, or system errors.
5. Payment Methods
Accepted payment methods may include credit/debit cards, approved digital payment methods,
ACH, wire transfer, invoice billing, or other methods we choose to offer.
Standard website pricing may reflect payment processing costs.
Discounted pricing may be available for ACH, wire transfer, or approved commercial account
purchases.
No shipment is required until cleared payment is received unless written credit terms are granted.
6. Commercial Credit Terms
Commercial Buyers may request Net 15, Net 30, or other credit terms subject to approval.
Credit approval may require business references, tax documentation, financial information, trade
references, guaranties, or internal review.

We may revoke or modify credit terms at any time.
Late balances may incur service charges at the lesser of 1.5% per month or maximum lawful
rate.
Commercial Buyers are responsible for collection costs and reasonable attorneys’ fees where
lawful.
7. Buyer Responsibility / Fitment
All buyers are responsible for confirming dimensions, specifications, compatibility, capacity,
installation requirements, and suitability prior to purchase.
Commercial Buyers acknowledge responsibility for technical review and application suitability.
8. Shipping and Delivery
Shipping dates are estimates only unless expressly guaranteed in writing.
Partial shipments may occur.
Buyer must inspect deliveries promptly and report visible damage immediately.
Cross-border shipments to Canada may involve duties, taxes, brokerage fees, or delays outside
our control.
9. Returns
Consumer returns and Commercial Buyer returns may be handled differently where permitted by
law.
All returns require prior authorization and RMA approval.
Approved returns are subject to a minimum 15% restocking fee, which may be higher depending
on product condition, packaging, age, or handling.
Custom-built, modified, made-to-order, special-order, or non-stock products are non-returnable
except where required by law.
Commercial Buyers may have reduced or no discretionary return rights for installed, used,
opened, or business-specific goods.
10. Warranty
Unless otherwise stated, eligible products carry a two (2) year limited warranty against defects in
material and workmanship under normal intended use.
Our sole obligation is repair, replacement, credit, or refund at our option.
Warranty excludes misuse, improper installation, abuse, racing use, overheating, contamination,
alteration, neglect, and normal wear.
Labor, downtime, lost profits, incidental damages, and consequential damages are excluded to
the maximum extent permitted by law.
Some consumer rights may vary by jurisdiction and cannot be waived where prohibited.
11. Quotations / Uploads
By submitting drawings, CAD files, dimensions, or technical materials, you represent that you
have authority to submit them.
You remain responsible for design accuracy, regulatory compliance, intellectual property rights,
and application suitability.
Quotes rely on information supplied by customer.
12. Chargebacks / Payment DisputesCustomers agree to contact us first to resolve billing, shipping, or product concerns before
initiating payment disputes.
Commercial Buyers agree not to misuse consumer chargeback procedures to avoid legitimate
commercial payment obligations.
13. Limitation of Liability
To the maximum extent permitted by law, Company shall not be liable for indirect, incidental,
special, punitive, or consequential damages.
For Commercial Buyers, total liability shall not exceed the amount paid for the specific product
giving rise to the claim.
Nothing in these Terms limits mandatory non-waivable consumer rights where prohibited by
law.
14. Governing Law
These Terms are governed by the laws of the State of Ohio, except where mandatory consumer
laws require otherwise.
15. Venue
Disputes shall be brought in courts located in or serving Ohio, except where prohibited by
applicable consumer protection law.
16. Changes
We may update these Terms by posting revised versions on this website.
